Mayorkas Basically Abolished ICE!!!
The Immigration and Customs Enforcement (ICE) agency was effectively dismantled by Homeland Security Secretary Alejandro Mayorkas over a two-week period, from September 30 to October 12. The elimination of the agency that apprehends and deports illegal aliens has become a rallying cry for the far left, and it has been endorsed by several Democratic presidential candidates – but not Joe Biden.
The ICE headquarters on 12th St. S.W. in Washington, D.C. is still there. There are still dozens of field offices scattered across the country. The agency's 10,000 employees are still getting paid. However, the agency's immigration enforcement functions have all but vanished as a result of two memos issued by Mayorkas. To be clear, ICE wasn't doing much before Mayorkas' edicts - agents were making one arrest every two and a half months on average – but now it's official: ICE has been instructed to stand down.
Mayorkas' first memo, Guidelines for the Enforcement of Civil Immigration Law, was issued on Sept. 30 and defines who ICE agents may arrest and deport among the 15 million or more illegal aliens in the United States. Mayorkas limits enforcement to just three types of illegal aliens under the pretense of "setting priorities": those considered dangers to national security, such as terrorists and spies; violent criminals; and those who entered the country after Nov. 1, 2020. Even these categories are more condensed than they look.
Between 1990 and 2019, a total of 1,485 spies were caught in the United States, with 583 of them being native-born Americans, according to the Cato Institute (a libertarian think tank that favors mass immigration). According to the Department of Justice, 402 foreign terrorists were detained on American territory between September 11, 2001 and December 31, 2016.
Mayorkas' memo makes certain significant exclusions when it comes to removing serious felons. "The seriousness of an apprehension and deportation on a noncitizen's life, and perhaps the lives of family members and the community," Mayorkas said.
ICE officials will not deport violent felons who are "advanced or vulnerable in age," have lived in the United States for a "lengthy" period of time, have a mental disorder that led to their criminal behavior, or whose removal would leave dependents behind. As a result, the sweet spot for ICE agents trying to perform their jobs is identifying a violent criminal who isn't too young or too old, mentally capable, and doesn't have any children. That should keep them occupied for a while.
Individuals who were in the nation for less than 11 months on the day Mayorkas released his memo fall into the third category, which is nothing more than a moneymaking opportunity for those who sell forged rent receipts and pay stubs.
Mayorkas, on the other hand, was not satisfied with proclaiming practically all illegal aliens untouchable by law enforcement. He issued a second decree on Oct. 12 nullifying the legislation preventing employers from hiring illegal immigrants. That fundamental feature of the 1986 Immigration Reform and Control Act (for which Senator Joe Biden supported) was designed to abolish the job magnet that attracts illegal immigrants to the United States. Worksite enforcement operations, when pursued (as they were under the Trump administration), had the twin effect of apprehending a high number of deportable foreigners while also punishing scofflaw companies with significant financial and criminal penalties, discouraging others from doing the same.
Only employers who "exploit" illegal alien labor will face enforcement action under Mayorkas' directive. Employers who abuse workers, regardless of their immigration status, should face further fines, it goes without saying. Companies now have the green light to hire illegal aliens over American workers under new ICE policies, as long as they meet certain minimum employment standards – an ironic stance given that the president prides himself on being a working-class ally and frequently invokes his own blue-collar upbringing and struggles.
With only 25% of the public supporting the Biden administration's immigration policy, completely disbanding ICE may have been politically impossible, so Mayorkas has done the next best thing: he has quietly abolished practically all of its operations.
