Washington & Lee University Students Were Banned From Passing Out Flyers In Support Of Glenn Youngkin.


According to the Foundation for Individual Rights in Education, students at Washington & Lee University (W&L) in Lexington, Virginia, were warned to stop distributing out posters in support of the state's Republican gubernatorial candidate, Glenn Youngkin.

Lillian Gillespie, president of W&L's College Republicans branch, remarked, "I was astonished when I found out that we couldn't distribute campaign materials on campus." "I believe that by making this story public, students on all sides of the aisle will feel more empowered and free."

According to FIRE, a university administrator told the student group that they could not advocate for candidates who were actively running for office and falsely blamed the school's tax-exempt status for the censoring.

W&L is now being urged to "quickly say that it will allow student clubs to openly support political candidates."

The apparent move by W&L is strange, given that the College Republicans is a student organization well-known for advocating for political candidates on college campuses around the country.

According to FIRE, the W&L College Republicans set up a booth at the university's annual activities fair on September 12, where they displayed campaign materials in support of Youngkin.

During the fair, however, Director of Student Activities Kelsey Goodwin told the group that their display was against university policy and that they needed to remove all materials endorsing political candidates, according to FIRE. Goodwin justified her request by citing W&L's status as a tax-exempt organization that cannot endorse political figures.

While W&L cannot promote candidates, the same cannot be said for students, whose speech does not jeopardize the university's tax-exempt status, according to the group.

FIRE stated that it informed the university of this in a letter dated September 23 and that the institution did not respond to FIRE's email, but did meet with Gillespie on September 30 and October 18.

During the discussions, Goodwin told Gillespie that the university had never allowed student organizations to exhibit materials campaigning for political candidates and that if he had any legal concerns, he should contact the institution's counsel.

Goodwin added that she was "startled" to learn that FIRE had written to the institution.

W&L eventually retaliated, warning conservative students that they were still not allowed to campaign for their candidate, according to FIRE.

"What good are College Republicans or College Democrats if they can't truly advocate for a Republican or Democrat?" Sabrina Conza, a FIRE program analyst, inquired.

"Goodwin's assessment of the legislation is incorrect, and the university's silence after censoring students who want to participate in the political process is incorrect." Now it's up to them to set things right," Conza continued.

W&L, according to FIRE, "must live up to the promises it makes in regard to student expression," despite the fact that it is a private institution not bound by the First Amendment.

"W&L adopted the Chicago Statement defending freedom of expression in December 2015, but its promises are worthless until W&L defends student expression," the association stated.
